Terms of use

These Terms of Use (“Terms”) govern access to and use of Shout Mailz (the “Service”), a product of JrodCode (“JrodCode,” “we,” “us,” or “our”), the parent company of Shout Mailz. By creating an account or using the Service, you agree to these Terms.
1. The Service
Shout Mailz provides tools to manage contacts, email templates, campaigns, and team workspaces. You supply and configure your own SMTP and AI providers. We do not provide or meter outbound email delivery or AI generation capacity as part of the subscription; plan limits apply to workspace resources (contacts, templates, campaigns, and seats) as described in the product.
2. Accounts
You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account, including invited team members. Owner accounts may enable authenticator-app two-factor authentication. We may suspend or disable accounts that violate these Terms or applicable law.
3. Acceptable use
You may not use the Service to send unlawful, deceptive, or unsolicited bulk email in violation of anti-spam laws, to infringe others’ rights, to probe or disrupt systems, or to misuse another person’s data. You must honor unsubscribe and suppression obligations for your own campaigns.
4. Your content and providers
You retain ownership of content you upload (including contact lists and campaign copy). You grant JrodCode a limited license to host and process that content solely to operate the Service. Your use of third-party SMTP or AI providers is governed by those providers’ terms; we are not responsible for their availability, policies, or charges.
5. Plans and billing
Paid plans are billed through Stripe according to the plan you select. Fees are generally non-refundable except where required by law. Failure to pay may result in downgrade, past-due status, or loss of paid features. Free plan limits may change with notice via the Service.
6. Privacy
Our Privacy Policy explains how we collect and use personal information. By using the Service, you also acknowledge that policy.
7. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, JrodCode disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that campaigns will achieve any delivery or engagement outcome.
8. Limitation of liability
To the fullest extent permitted by law, JrodCode and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our aggregate liability for claims relating to the Service will not exceed the amounts you paid to us for the Service in the twelve months before the claim.
9. Termination
You may stop using the Service and delete your owner account where the product allows. We may suspend or terminate access for breach of these Terms or risk to the Service or other users. Provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive termination.
10. Changes
We may update these Terms by posting a revised version on this page and updating the effective date. Continued use after changes become effective constitutes acceptance of the updated Terms.
